COMPETENCIA SANCIONA AL COLEGIO DE ARQUITECTOS DE SEVILLA POR INCUMPLIR LOS COMPROMISOS ADQUIRIDOS EN LA TERMINACIÓN CONVENCIONAL DEL EXPEDIENTE SANCIONADOR S/09/2014
El Consejo de Defensa de la Competencia de Andalucía impone una multa de 36.000 € al Colegio Oficial de Arquitectos de Sevilla por incumplir la Resolución de 12 de marzo de 2014 por la que dicha Corporación asumió, en el marco de la terminación convencional del expediente sancionador S/09/2014, una serie de compromisos, entre ellos, el envío de una carta a todos los Ayuntamientos de la provincia de Sevilla rectificando y aclarando que “no existe una ley específica sobre atribuciones profesionales que establezca reserva alguna a favor de un técnico concreto para las funciones de informar y asesorar en materia de gestión y disciplina urbanística”.
Además, el CDCA exige al COAS dar cumplimiento de los compromisos acordados en la terminación convencional anteriormente referida en el plazo de 10 días desde la notificación de la Resolución, estableciendo una multa coercitiva por importe de 900 € diarios en el supuesto de que el Colegio incumpla esta obligación en el plazo concedido.
Por último, la Resolución que ahora se adjunta (VS 01/2015) interesa al Departamento de Investigación de la Agencia de Defensa de la Competencia de Andalucía la instrucción de un expediente por incumplimiento, por parte del COAS, de la Resolución de 12 de marzo de 2014.
