Sentencia del TSJ de Andalucía conformando la competencia de los Arquitectos Técnicos para dirigir proyectos de instalación de grúas y certificar su puesta en servicio para la ejecución de obras de construcción.
Sentencia del Tribunal Superior de Justicia de Andalucía, Sala de lo Contencioso Administrativo de Granada, de 23 de febrero de 2015, por la que se estima el recurso de apelación presentado por el COAAT de Granada contra sentencia en primera instancia que negaba la competencia de los Arquitectos Técnicos para la dirección técnica de la ejecución del proyecto de instalación de grúa torre.
En base al criterio de accesoriedad vinculado con la especialidad propia de los Arquitectos Técnicos, el TSJ afirma que “La facultad de montar una torre grúa en este caso es una atribución relacionada con la ejecución de obras y puede ser ejercitada por el arquitecto técnico que lo hace en el marco y en el desarrollo de la obra de edificación para la construcción de 15 viviendas unifamiliares”. Añade la sentencia que “no se trata de que la grúa sea instalación fija o equipamiento de una edificación sino de atender a su accesoriedad en el proceso de ejecución de la obra de edificación.”
